Zack Mulhall, the Oklahoma cattleman, is to have a new trial. He was convicted of killing a by-stander while making a "gun play"
on the Pike at the St. Louis World's fair. A St. Louis court sentenced him to three years in the penitentiary. The case was appealed
and the state supreme court has reversed it and remanded it for a new trial.
The shooting which got Mulhall into trouble was in front of the Cummings Wild West show on the Pike, June 17, 1904. Frank Reed,
a hostler in the employ of the show, arousted Mulhall's anger by riding a horse which Mulhall did not want him to ride.
After a quarrel Mulhall, it is said, drew his revolver. In a struggle with another employee named Murray, who interferred,
it was discharged and Murray was wounded. Mulhall then fired several shots and Reed and Earnest Morgan, a St. Louis boy who ran up to
see the fight were wounded. Reed and Murray recovered, but Morgan's wound was fatal.
Miss Lucille Mulhall, who is said to be the best woman rope thrower in the territories, was with Mulhall at the time of the shooting
and was a witness for him at the trial.
